(a)   Large domestic animals shall include, but not be limited to; horses, donkeys, mules, sheep, llamas, emus and goats.

(b)   Poultry shall include chickens, ducks, geese or similar domesticated fowl.

It shall be unlawful for any person to maintain or harbor larger domesticated animals within the following area in Stafford, Kansas:

Within a boundary starting at US-50 North on Buffalo to Camden St.

East one block to Cherry St.

West on Vickers to North Boston.

North on Boston along the plotted street to Aurthur St.

West on Aurthur to Mincer St.

South on Mincer to Stafford St.

West on Stafford along the plotted street 420 feet.

Back South to Broadway and across.

East on Broadway to Prairie St.

South on Prairie St. to Crawford St.

Along the plotted old railroad to US-50.

East on US-50 to Buffalo St.

The owning or possessing of any fowl described in Section 2-401 and held within the prohibited area as defined by Code Section 2-402 is hereby prohibited, except: (a) caged birds kept as pets within a residential structure; (b) the owning or possessing of not more than twelve (12) chickens per residence in the prohibited area. No one shall own ducks, geese, or other domesticated fowl in the prohibited area. There shall be no roosters allowed within the prohibited area. There shall be no free range allowed. Chickens must be kept in an enclosed pen, with a minimum of 15 square feet per chicken. Those persons who currently possess such fowl that has been prohibited, shall be given 90 days from the date that Ordinance No. 1082 is published to dispose of said animals.

There shall be an annual fee of $20 to possess chickens within the city limits. The fee shall be paid by April 1 of each year. The owner by paying the fee consents to the inspection of the chicken pen at a random time each year by the Police department to ensure that the pen is clean and safe for the chickens.

Citizens shall have 90 days to comply after the effective date (publication date) of Ordinance No. 1035.

Those found in violation of this article shall be guilty of a Class C misdemeanor as defined by the city code.  Every day that there is non-compliance with this article the violation shall constitute a separate offense.

No owner or possessor of large animals shall keep any animals outside the prohibited area set out in section 2-402 within the city limits of Stafford, Kansas on any tract of land that is less than one acre or less than 43,560 square feet in size.  A tract of land shall be considered as all of the land owned by the same person or persons that is contiguous.

There shall be no more than two large animals on any tract of land outside the prohibited area set out in section 2-402 within the city limits of Stafford, Kansas.  In the event that the animals have offspring, then the owner shall be allowed to retain the offspring for six months after birth.  At that time the owner is allowed to keep no more than two animals total.

The first offense of this article shall be a mandatory fine of $500.00.  Any subsequent violation shall be a fine of $1,000.00.

Fence for any large domestic animal must have a 16 feet wide gate for emergency response entrance, fence must be set back 27 feet from the center of the road with a minimum of 200 feet from the nearest residence on any adjoining side of the fence.

No animals of any species shall be kept within 100 feet of any public water well owned by the City of Stafford, Kansas.
